Porupo Terms of Service

These Terms of Service (the "Terms") govern your access to and use of our services, including our various web pages, APIs, email notifications, applications, advertisements, merchant services and our other services linked to these Terms (collectively, the "Services"), and any information, text, links, graphics, photos, audio, video or material or arrangement of material uploaded to or appearing on the Services (collectively, the "Content").

By using the Services, you agree to be bound by these Terms.

Who may use the Services
You may use the Services only if you are at least 16 years of age or older.

Privacy
Our Privacy Policy (https://porupo.org/privacy) describes how we handle the information you provide to us when you use our Services. You understand that by your use of our Services, you consent to the collection and use (as set forth in the Privacy Policy) of this information.

Content of the Services
You are responsible for your use of the Services and any Content you provide, including compliance with applicable laws, rules and regulations. You should only provide Content to us that you wish to share with others. Any reliance you place on or use of any Content or material posted via or obtained through the Services is at your own risk.
We do not endorse, support, reaffirm or warrant the completeness, truthfulness, accuracy or reliability of any Content or communication posted via the Services, nor do we endorse any opinion expressed via the Services. You understand that by making use of the Services, you may be exposed to Content that may be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that may have been misinterpreted or may be otherwise misleading.
All Content is the sole responsibility of the person producing it.
We do not monitor or control the Content posted via the Services, and cannot be responsible for such Content.
We reserve the right to remove Content that violates the User Agreement, such as copyright or trademark infringement or any other misuse of intellectual property, impersonation, unlawful conduct or harassment.

Your Rights and Assignment of Content Rights
You retain your rights to any Content you submit, post or display through our Services. What's yours, is yours: you own your Content (and any embedded audio, photos and videos that are considered part of the Content).
By submitting, posting or displaying Content through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods now known or later developed (for clarification purposes, these rights include, for example, rights of arrangement, transformation and translation).
This license authorizes us to make your Content available to the rest of the world and to allow others to do the same.
You agree that this license includes the right for Porupo to provide, promote and enhance the Services and to make Content submitted to or through the Services available to other companies, organizations or individuals for syndication, broadcast, distribution, response, promotion or publication of such Content in other media and services, subject to our terms and conditions for the use of such Content. Such additional uses by Porupo or other companies, organizations or persons will be made without payment to you of compensation with respect to Content that you have submitted, posted, transmitted or otherwise made publicly available through the Services, as you agree that your use of the Services constitutes sufficient compensation for the Content and assignment of rights contemplated herein.

You represent and warrant that you have, or have obtained, all rights, licenses, consents, permissions, permissions, powers and/or authorizations necessary to grant the rights granted herein for any Content that you submit, post or display on or through the Services.
You agree that such Content shall not contain copyrighted or other proprietary materials unless you have the necessary permission or are legally entitled to post such materials and to grant Porupo the license described above.

Use of the Services
Our Services are constantly being updated. As such, the Services may change from time to time, at our discretion. We may generally discontinue providing you or other users with the Services (permanently or temporarily) or any features of the Services. We also retain the right to set limits on use and storage in our sole discretion at any time.
We may also remove or refuse to distribute any Content found on the Services, limit the distribution or visibility of any Content within the service, suspend or terminate users and reclaim usernames without any liability to you.
You also agree not to make inappropriate use of the Services, for example, by interfering with the Services or accessing the Services using a method other than the interface and instructions provided to you by us.
You will not do any of the following when accessing or making use of our Services: (i) access, sabotage or use non-public areas of the Services, Porupo's computer systems or Porupo's suppliers' technical systems; (ii) test, scan or test the vulnerability of any system or network or breach or circumvent any security authentication measures; (iii) access or investigate or attempt or access or investigate the Services in any way (automatically or otherwise) other than through our interfaces currently available, published and provided by Porupo (and only on the applicable terms and conditions), unless you have been specifically permitted to do so by a separate agreement with Porupo; (iv) insert any TCP/IP packet header or any part of the header information in any email or posting, or use the Services in any way to send altered, erroneous or false source identification information; or (v) interfere with or hinder (or attempt to interfere with or hinder) the access of any user, host or network, including, without limitation, the sending of viruses, overloads, hoards, spam, bombardment of Service emails, or inserting script in the creation of Content in such a way as to interfere with or create an undue burden on the Services.
We also reserve the right to access, read, preserve and disclose any information that we believe is reasonably necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations thereof, (iii) detect, prevent or otherwise address fraud, security or technical issues, or (iv) respond to user requests for assistance, or (v) protect the rights, property or safety of Porupo, its users and the public.
Porupo does not disclose personally identifiable information to third parties, except as provided in our Privacy Policy.

Terrorist Activities
Use of Porupo's services to promote terrorist activities including audio, photos and videos of terrorist activities.

Child Pornography and Protection of Minors

One of our main objectives as a community is to protect minors, so we do not allow fictional representations in manga, anime and video games of the genres known as lolicon and shotacon, this does not mean that freedom of expression is limited, since this rule only applies if the content simulates a minor (real or fictitious) in any sexual or erotic activity, also any representation (real, simulated or fictitious) of a minor representing sexually explicit situations, full or partial nudity, real or simulated will be considered child pornography and your account will be deleted.
Child pornography includes related material such as simulated child pornography, child pornography without nudity or sites linking to such material, whether determined to be legal or not.
Offenses of this nature will be reported to federal authorities and prosecuted to the fullest extent of the law.
The User is fully responsible for any misuse of the account, regardless of who committed the act.

Suicide
You may not encourage or promote suicide or self-harm, meaning you may not share videos, images or information about it.

Sensitive multimedia content and NSFW or adult content
Media that is excessively morbid, violent or adult content in live videos or in profile or cover images is strictly prohibited. Multimedia content depicting violence or sexual abuse is also not allowed, whether real, simulated or fictitious.

For a healthy coexistence, which does not limit the freedom of expression and fair use under our Community Guidelines we require that all adult content posted on Porupo be kept behind the NSFW category, i.e. you can create a private group that is under the NSFW category which will indicate that access is only for those over 18 years old.

If you are a group administrator you must classify your group as NSFW if your community is organized around NSFW topics or if the majority of the content of your group focuses on 18+ content and you are obliged to respect the rules and not accept minors in your group, otherwise your group will be removed including your community as a sanction.
If you are between 13 and 17 years old, you will not be allowed to join, create, or view NSFW group content.

You may not post or share intimate photos or videos of another person that have been obtained or distributed without that person's consent, this means that; content captured with hidden cameras and showing full or partial nudity is prohibited, "porn revenge" is prohibited, "upskirts" is prohibited: images or videos of a person's buttocks, which are taken under the skirt, dress or other clothing, and that allow you to see the genitals and / or buttocks of the person.

You may share any NSFW or ecchi content on your profile or channel as long as it does not contain sexually explicit material, i.e. masturbation, exposed genitalia and overly sexual poses. If you consider that your content may break the Community rules you can censor your content and publish it. Additionally we will add a censorship filter that will be at the user's discretion whether to view this content or not.

If you consider that a user, channel and/or group is breaking the Community rules you can report this material with the report button, an admin will review your notification and apply the corresponding sanction.

Your account
You may need to create an account to use any of our Services.
You are responsible for the security of your account, so you must use a strong password and limit your use to this account.
We cannot and will not be liable for any loss or damage arising from your failure to comply with the above conditions. You can control most communications from the Services. We may be required to provide you with certain communications, such as service announcements and administrative messages. Such communications are considered part of the Services and you may not opt out of receiving them from us or your account.

Termination of these Terms
You may terminate your legal agreement with Porupo at any time by deactivating your accounts and discontinuing use of the Services. We may suspend or terminate your account, or cease providing all or part of the Services to you, at any time and for any reason, or for no reason, such as if we reasonably believe: (i) that you have violated these Terms or Porupo's Rules and Policies or Community Guidelines; (ii) that you cause us risk or potential legal liability; (iii) that your account should be terminated due to unlawful conduct; or (iv) that your account should be terminated due to your prolonged inactivity; or (v) that providing the Services to you is no longer commercially viable.
We will use reasonable efforts to notify you via the email address associated with your account or the next time you attempt to access your account, depending on the circumstances. In all such cases, the Terms will terminate, including, without limitation, your license to use the Services.
